  1. These terms and conditions relate to your application to participate in a talent search competition being filmed for a series of television programmes provisionally entitled
    “Britain’s Got Talent” and any support programmes (the “Programme”) which FremantleMedia Limited trading as Thames and Maidmetal Limited trading as Syco Entertainment (together, the “Producer”) propose but do not undertake to produce for ITV. The information given by you in your application may be used in the Programme should you be selected to audition.

  2. You are not eligible to apply to enter this competition if you are an employee or a close relation of an employee of ITV plc, FremantleMedia Limited, Maidmetal Limited or any parent, subsidiary or associated company.
     

  1. How We Use Your Data

    1. Both the Producer and ITV take your privacy very seriously. By submitting this application form, you are indicating that you understand, acknowledge and (where relevant) consent to FremantleMedia Limited collecting and using your personal information in the ways explained to you in FremantleMedia Limited’s Privacy Notice for Programme Applicants, a copy of which is available here: https://fremantle.co.uk/privacy-notice-applicant.pdf or by emailing privacy.officer@fremantle.com .
    2. From time to time the Producer may need to send some of your personal information to ITV for broadcast compliance reasons (for example, to fact check content and/or check it complies with broadcasting codes). To the extent any personal data is shared with ITV for such purposes, ITV’s privacy policy (https://www.itv.com/_data/documents/pdf/ITV_Broadcasting_Privacy_Notice.pdf) shall apply to such use of your personal data by ITV. If you have ticked the relevant box on the application form then FremantleMedia Limited and Maidmetal Limited may also use the contact details provided to let you know about other television programmes being produced which may be of interest to you.
    3. If you have any questions regarding our use of your personal information or if you would like to update your information because your details have changed, please send an e-mail to privacy.officer@fremantle.com marked for the attention of the Privacy Officer, or contact the Privacy Officer by post at FremantleMedia Limited, 1 Stephen Street, London W1T 1AL.
  2. You acknowledge and agree to abide by the rules, regulations, terms and conditions for this competition as determined by the Producer (the "Rules") and you acknowledge that the Rules may be changed (including without limitation verbally) at any time by the Producer in its sole discretion. The Producer’s decisions regarding all elements of the application process, the competition and the Programme shall be final and binding.

  3. Applications can be made online at www.itv.com/talent . Online Applications close on 11th January 2025 at 23:59 GMT or at such other date and time as the Producer may elect and as stated on itv.com/talent or any other promotion.

  4. The Producer reserves the right to introduce other application methods in its sole discretion and the closing dates for such methods will be as stated in the relevant promotion.

  5. Additional recruitment or contribution terms of use available at itv.com/terms apply. If there is any conflict between these terms and the terms on itv.com, these terms will prevail.

  6. The Producer, its agents and sub-contractors do not accept any responsibility whatsoever for any technical failure or malfunction or any other problem with any online applications, telephone networks, line, system, server, provider or otherwise which may result in any applications not being properly received.

  8. Any applications received after the closing date will not be considered.

  9. Applicants may be selected and invited to attend an audition at a time and location to be decided at the sole discretion of the Producer whose decision will be final and binding.

  10. Applicants who are not available for a first round audition may still be considered for a second round audition on the basis of a submitted DVD or video clip at the sole discretion of the Producer whose decision will be final and binding.

  11. Acts may be invited to audition for the series by researchers acting on behalf of the Producer. Such acts will be required to audition on the same basis as any other applicant and normal programme Rules will apply.

  12. The completion of an application does not guarantee that an applicant will receive an audition or participate in the Programme.

  13. If you are under 18 years of age please make sure that you get the permission of your parents or legal guardians before applying.

  14. If you are under 18 years of age and you are invited to audition, you must be accompanied by your parents or legal guardians at the audition. Proof of age will be required at the auditions.

  15. You hereby warrant that you have the right to be in the UK, perform in the Programme and take up any related prize and/or prize agreement and are able to demonstrate such right on request by the Producer at any time and you agree to notify the Producer immediately of any change in your immigration status.

  16. In the event that you are invited to attend an audition you hereby irrevocably grant all consents necessary for the Producer to film and record such audition and to use recordings featuring your image and/or voice in connection with the Programme and/or ancillary rights in the Programme and to exploit the same in all media throughout the world in perpetuity without the need for payment to you.

  17. In the event that you are invited to attend an audition, you must ensure that you have obtained all necessary and proper immunisations for any animals involved in your act and you will provide to the Producer all documentation or do any other acts as may be reasonably necessary for the Producer to determine whether the animal is safe to participate in the Programme. You must notify the Producer, in advance, if you intend to:

  1. perform physical and/or dangerous stunts, explaining the full nature of the stunt; or

  2. use any form of equipment required as part of your act. You will be responsible for bringing such equipment (provided it is suitable for the audition location) and are responsible for ensuring that such equipment is safe and/or suitable for its purposes. Pyrotechnics are not permitted.

  1. The Producer does not cover any costs that applicants incur in order to audition for the Programme save for exceptional cases where reasonable pre-agreed expenses may be covered at the Producer’s sole discretion.

  2. Should the Producer cover pre-agreed expenses in connection with an applicant’s audition, only expenses for the key members of any act will be covered and not for any management, friends or family.

  3. Situations where pre-agreed expenses may be covered are:

  1. if, for production reasons, an applicant is allocated an audition before the Programme judges in a town/city at a substantial distance from the applicant’s original audition before producers.

  2. where, for production reasons, video applicants are offered an audition before the Programme judges in a town/city at a substantial distance from their home.

  3. if any applicant requires specific equipment for their act which has associated transportation costs. In this case, the Producer may contribute to the reasonable cost of transportation or arrange the hire of similar equipment locally if cheaper.

  4. if an act is required to audition at a time where same day travel home may be difficult, the cost of alternative transport or overnight accommodation may be considered.

  1. Should you be selected to take part in the Programme you agree and undertake to enter into further contracts with the Producer and you agree to abide by the terms therein.

  2. All personal details and/or information given in your application either in this form or otherwise must be truthful, accurate and in no way misleading.

  3. The Producer reserves the right to disqualify you if you have supplied untruthful, inaccurate or misleading personal details and/or information, have failed to abide by the Rules and/or are in breach of the terms hereof.

  4. You will not, without the Producer’s prior written consent, disclose, publish or discuss with any third party any information relating to the Programme, your appearance in the Programme, the production team, or any participants in the Programme nor any other information which may come to your attention including without limitation in relation to the broadcaster, the Producer or otherwise save where such information is already in the public domain.

  5. You must disclose to the Producers details of any unspent convictions other than driving offences which have not resulted in a ban or custodial sentence in addition to any charges that have been brought against you that are still pending. You shall notify the Producers immediately if there are any criminal charges brought against you or if any information you provide in your application becomes inaccurate between now and the date of first transmission of the Programme.

  1. These terms and conditions relate to your WhatsApp video application including without limitation any and all comments, images, audio-visual content and/or any other materials submitted in and in connection with such application (the “WhatsApp Application”) to participate in a talent search competition being filmed for a series of television programmes provisionally entitled “Britain’s Got Talent” and any support programmes (the “Programme”) which FremantleMedia Limited trading as Thames and Maidmetal Limited (together, the “Producer”) propose but do not undertake to produce for the broadcaster, ITV. For the avoidance of doubt, Britain’s Got Talent Series 18 Application Terms and Conditions at, https://eu.castitreach.com/a/fmuk/bgt18/tnc, shall also apply. The information given by you in your application may be used in the Programme should you be selected to audition.
  2. How We Use Your Data
    1. Both the Producer and ITV take your privacy very seriously.   3. To submit your WhatsApp Application you must be a registered user of WhatsApp and you must abide by WhatsApp terms of use, available at https://www.whatsapp.com/legal/#terms-of-service .
  4. Your WhatsApp Application must be submitted to the designated Producer phone number +44(0)7387361518 together with any other required details. You must submit your WhatsApp Application before 23:59 GMT 11th January 2025 or at such other time as the Producer may elect.
  5. Your WhatsApp Application should be no longer than 5 minutes. 
  6. Your WhatsApp Application must have been recorded within the last 12 months, and must not be edited, distorted or enhanced in any way.
  7. Please ensure that you are the only person featured in your WhatsApp Application or, for group applications, that only members of the group as named in your WhatsApp Application are featured, and that you have the consent of all group members to submit the WhatsApp Application and for us to use the WhatsApp Application. You acknowledge that the contents of your WhatsApp Application will not be considered confidential.
  8. If you are under 18 years of age you must obtain the consent of your parent or legal guardian before submitting your WhatsApp Application. If you are submitting a group WhatsApp Application featuring anybody under the age of 18 you must ensure you have the consent of their parent or legal guardian before submitting the WhatsApp Application.
  9. Your WhatsApp Application must not contain any material which is in any way defamatory, obscene, unlawful, harmful, offensive or inappropriate or which infringes the rights of any third party. You must not to advertise or promote third parties' or your own goods or services in your WhatsApp Application.
  10. You agree not to endanger yourself or others, take any unnecessary risks in order to produce or make a WhatsApp Application.
  11. By submitting your WhatsApp Application you hereby grant us an exclusive and irrevocable licence to use, edit, reproduce, distribute, transmit, broadcast, make available and display your WhatsApp Application (or part of your WhatsApp Application) (including but not limited to your performance) without charge by any medium or method now known or later invented including without limitation online or television to be exercised in our sole discretion throughout the world in perpetuity without restriction. As this licence is exclusive, you agree that only we may use your WhatsApp Application so you must not upload it anywhere else. You agree that we may permit other parties authorised by us including without limitation ITV group companies a licence of your WhatsApp Application for their use. You shall waive and procure that the director of your WhatsApp Application shall waive any moral rights that may exist in relation to your WhatsApp Application.
  12. You are responsible for the content of your WhatsApp Application. You promise that you are fully authorised and entitled to submit the WhatsApp Application in accordance with these terms and conditions, and that by doing so you will not infringe the copyright or other rights of any third party, or infringe any applicable laws or regulations. You promise that you have all necessary licences, rights, permissions and consents to enable you to submit the WhatsApp Application and to authorise us to use the WhatsApp Application. You agree to give us evidence of such licences, rights, consents, and permissions if requested by us. You also agree not to transfer files which contain viruses or other harmful programs. 
  13. By submitting your WhatsApp Application you are signifying your agreement to these terms and conditions, including without limitation Britain’s Got Talent Series 18 Application Terms and Conditions at www.itv.com/terms, and consenting to your WhatsApp Application being used for purposes related to Britain’s Got Talent. If you do not accept any of these terms and conditions, do not submit your WhatsApp Application. We reserve the right to disregard any WhatsApp Application which in our opinion fails to meet the eligibility criteria set out in the applicable terms and conditions.
  14. We may accept or reject your WhatsApp Application at our sole discretion. Nothing in these terms guarantees that we will use or display your WhatsApp Application. 
  15. References to “we”, “us” and “our” are to FremantleMedia Limited trading as Thames, 1 Stephen Street, London W1T 1AL.
